Litigation valuation is a different discipline from lending appraisal. The standard isn't "reasonable market value for loan purposes" — it's "will this analysis survive deposition and cross-examination by a skilled opposing expert?"

Martinez & Associates is retained exclusively for non-lending purposes. Every report we produce is developed with the litigation timeline and evidentiary requirements in mind from the first site inspection. We do not rewrite lending reports for court use — we build litigation-grade opinions from the ground up.

William Martinez has been qualified and has testified as an expert witness in California Superior Court on complex commercial and residential valuation matters. He has also appeared in U.S. District Court proceedings.

Engagement Process

Initial Consultation

We discuss the matter, the disputed value, timeline, and what the engagement requires. Conflict check completed. Fees quoted on a flat or hourly basis — no contingency arrangements.

Engagement Letter

Scope of work, deliverable format, and schedule confirmed in writing. For Rule 26 matters, we confirm the expert disclosure deadline and work backward to set internal milestones.

Analysis & Report

Property inspection, data assembly, and report drafting. All workfiles maintained to USPAP and RICS standards. Counsel reviews draft for privilege and procedural compliance before finalization.

Testimony

Deposition and trial testimony available. William Martinez prepares directly with retaining counsel. Exhibits and demonstratives provided in attorney-ready format.

Independent Appraisal Review

Appraisal Review for Litigation

Attorneys often come to us with an opposing report already in hand. The question is not just whether the number is wrong — it's whether the analysis will hold up under scrutiny in court.

We conduct independent appraisal reviews under USPAP Standards Rule 3. Our role is that of a neutral, impartial reviewer — not an advocate. We examine the work under review for completeness, accuracy, adequacy, relevance, and reasonableness of the analyses, opinions, and conclusions. Where warranted, we develop and report an independent opinion of value.

The resulting review report identifies specific analytical weaknesses, unsupported assumptions, and scope of work deficiencies — and is prepared to USPAP standards so it can withstand deposition and cross-examination.
